GENERAL, LEGAL BASIS

We are a company duly registered and existing under the law of Indonesia, operating in the telecommunication sector, specifically in providing Data Plans and eSIMs to our customers. We provide these services primarily through third-party marketplace platforms (such as Shopee, Tokopedia, and Lazada) and through payment links sent via WhatsApp, and the usage of our service, in whatever media and through whatever means, is subject to these Terms and Conditions. You are therefore obliged to read these Terms and Conditions in order to understand and know your rights and obligations.

Unless otherwise stated, all references to time and date in this agreement are in calendar days.

Except where otherwise stated, these Terms and Conditions do not apply to any third party. You are the person with whom we have a contract. We have no responsibilities to anyone else.

Kurolite may modify these Terms and Conditions from time to time and notify you of the changes. You can review the most current version of the Terms and Conditions at any time by reviewing the site. You are not automatically subjected to any changes in these Terms and Conditions and may terminate your use of the Service if you do not agree with any modification or amendment. However, if you use the Service after the effective date of an amendment or modification, you shall be deemed to have accepted that amendment or modification. You agree that you shall not modify these Terms and Conditions, and you also acknowledge that any attempts by you to modify these Terms and Conditions will be void.

These Terms and Conditions will be in effect the first time you access or use the Service, whichever is the earliest. These Terms and Conditions will be changed from time to time; however, the relevant changes will only be effective 14 (fourteen) calendar days after the Terms and Conditions are notified to you.

We are unable to identify our end-users; therefore, by purchasing a Kurolite eSIM and using the eSIM, you confirm that you are:

Lawfully able to enter into a contract or agreement based in Indonesia and other relevant jurisdiction(s);

Authorized to enter into agreements on behalf of the third parties you are representing (where applicable);

Ensuring that all of your provided information is accurate and up to date; and

Authorizing us to provide necessary data to, and to appoint, our affiliates, subprocessors, and any third-party service providers in order to be able to serve you.

In the execution of these Terms and Conditions, you will be required to comply with and agree to additional terms detailing how we handle and process your data (referred to as the Privacy Policy). The Privacy Policy is important and mandatory in order to ensure our service to you is delivered as effectively and efficiently as possible for your satisfaction.

"Kurolite", "we", "our" or other similar wording in these Terms and Conditions refers to PT. Inovasi Jelajah Dunia, or an asset of PT. Inovasi Jelajah Dunia, a company which conducts the selling of global eSIMs.

"You" specifically refers to a Visitor, Guest, and Kurolite End User.

INTELLECTUAL PROPERTY

1. We provide you a non-transferable, non-exclusive license to use the Service in consideration for your agreement to abide by these Terms and Conditions, our Privacy Policy, and the applicable marketplace or app-store terms (incorporated into these Terms and Conditions by reference), as changed from time to time. All other rights are reserved by us. We, which may include our affiliates or third parties, may own part of the elements in Kurolite's site, application, and service, as well as all Intellectual Property vested therein, including but not limited to copyrights, patents, database rights, trademarks, service marks, trade secrets, and moral rights. You agree that all material, product, service, and intellectual property provided in any form and on any relevant platform (including but not limited to marketplace listings) is the sole property of Kurolite. You agree not to reproduce or redistribute our intellectual property in any way to any third parties.
2. This service is made in order to simplify global connectivity with eSIMs for all of our customers when they are traveling or working abroad. Therefore, except as otherwise mutually agreed with Kurolite in writing, the license in point 1 above is given without the right to sublicense, transfer, or assign to any other third party. You agree that you shall not act as a subcontractor or transfer or share your order or delivery credentials to any third party without Kurolite's written consent.
3. In the event that you register any part of our Intellectual Property as defined in these Terms and Conditions, or if our Intellectual Property Right is acquired by operation of law or otherwise by you in any relevant jurisdiction, you / the acquiring party hereby assign and agree to assign all such rights, titles, and interests in and to such intellectual property back to Kurolite.
4. In the event that you / the acquiring party do not reassign such rights or refuse such a request from Kurolite, after reasonable written notice from Kurolite, Kurolite reserves the right to take any appropriate legal action and to pursue any appropriate legal remedies. This also applies if you violate these Terms and Conditions.
5. In a case where you become aware of any misuse of Kurolite's Intellectual Property or any violation of these Terms and Conditions or the Privacy Policy, we would greatly appreciate your notification to us regarding such misuse or violation.

COLLECTION OF INFORMATION

Customer Information.
Kurolite does not operate an account or login system. To provide our services, we collect the information you provide when purchasing an eSIM through a marketplace platform or via a payment link, including but not limited to your name, email address, and phone number, which we use to process your order and deliver your eSIM. Your eSIM is delivered via email or through customer support chat (WhatsApp and other social media).

Government Disclosures.
We are committed to protecting your privacy as our priority; however, at times we may be obliged by law to share information about you and your use of the Service with any government or other competent authorities. You acknowledge and consent to us making such disclosure. We would not share your information other than for the reasons explained in these Terms and Conditions.

Personal Data.
Kurolite complies with and operates under Indonesian law; therefore, the rules of Personal Data Protection in Indonesia will govern these Terms and Conditions. Disclosure of personal data is restricted and can only be made in order to satisfy legal due process, based on your consent, and for personalisation of our service for your convenience.

Ownership of Feedback.
We greatly appreciate your feedback to make Kurolite a better company to serve you. In order to make our service better, we would like your consent to automatically grant Kurolite a universal, royalty-free, perpetual, transferable license to any rights you may have regarding all feedback provided. By agreeing to these Terms and Conditions, you agree to provide us with such feedback.

TERMS REGULATING USAGE OF KUROLITE SERVICES

Payment under these Terms and Conditions is based on a pre-paid plan. To the extent permitted by law, all pricing may be changed at any time at our sole discretion. In changing pricing, we will try to do so as reasonably as possible; however, you understand and agree that due to factors outside of our control, in some situations it may not be possible to guarantee reasonable pricing changes.

You understand and agree that, except as clearly stated in these Terms and Conditions or permitted by Kurolite, you shall:

• Not duplicate Kurolite's sites or services (except where necessary for backup or operational security purposes); and
• Not rent, lease, sublicense, loan, edit, translate, merge, adapt, change, or modify the service in any way.

Kurolite does not and shall not have any proprietary rights to any data processed by you.

Kurolite will conduct its services to the highest standard possible as part of our daily operations; however, due to the involvement of third parties, it may sometimes be challenging and unavoidable to not have sufficient speed or coverage in a certain area or based on your needs, whether on 3G, 4G LTE, or 5G.

In relation to your use of the service, you are not permitted to use the eSIM to upload, generate, or use any word, comment, picture, voice, or other content that offends any ethnicity, religion, race, or group, or to access pornography, make threats, or engage in anything in contradiction of customs in Indonesia.

Any loss of an eSIM, whether caused by loss of a handset or other reasons, must be reported to Kurolite.

You agree that these Terms and Conditions shall be entered into digitally, and you will not challenge Kurolite regarding the validity of these Terms and Conditions on the basis of the legality of electronic consent. In the course of our operation, we may provide you the following information digitally:

• These Terms and Conditions and any amendments, modifications, or supplements to them;
• Your purchase and records through the Service;
• Any initial, periodic, or other disclosures or notices provided in connection with the Service, including without limitation those required by law;
• Any customer service communications; and
• Any other communication related to the Service or Kurolite.

You must promptly update us with any change in your email address and phone number (where necessary) so that we can continue to deliver your eSIM and related communications.

YOUR OBLIGATIONS RELATING TO THE SERVICES

You agree to pay us the fee charged for the purchase of the Data Plan and the use of the eSIM. Normally, for each purchase, unless otherwise specifically stated in these Terms and Conditions, any fee charged is not refundable.

Regarding your purchase and use of our service, you must provide us with:

• Accurate information about yourself;
• Updates to your information if it changes; and
• Information about at least one valid payment instrument or any other identification document that we may require.

You shall not, and you shall ensure that any person you allow to use the eSIM does not, copy, reverse engineer, modify, scrape, distribute malware, impersonate others, exploit, or use Kurolite's service for illegal activities.

You shall not distribute, sublicense, sell, resell, lease, or create derivative works based on all or any part of the service without prior written approval from Kurolite.

You are generally responsible for all activities related to your use of the service, including without limitation any data displayed, generated, or published arising from and related to your use of the service, and for any losses incurred as a result of any use of the Service in which you have acted fraudulently or negligently. You also agree to hold Kurolite and its related parties harmless from any and all losses, actions, or claims.

OUR OBLIGATIONS RELATING TO THE SERVICES

We will provide you with the highest service quality available; however, you understand and acknowledge that our eSIM Service may not be available, whether in whole or in part, in certain regions, countries, or jurisdictions.

We will provide you with accessible ordering and delivery channels to ensure the best experience when using our services.

We cannot guarantee that such access will not be stopped (downtime) due to technical or other unforeseen issues. Even so, we will use our best efforts to ensure the highest possible uptime and access to our services.

We will provide you with a dedicated support / customer service team that will help you with any technical or sales-related questions or enquiries.

We will provide you with education regarding your rights and responsibilities relating to personal data. Such information can be found in our Privacy Policy.

We may send service-related notifications via email, messaging, or any other relevant communication method. We will also provide you with up-to-date information on our platforms.

REFUND

A refund will only be provided in the event that an eSIM fails to connect due to a fault caused by Kurolite. No other circumstances qualify for a refund.

A request for a refund must be made by contacting our customer support (via email or WhatsApp). Whenever there is a refund request, Kurolite reserves the right to investigate the case and to accept or reject such request, including where the issue is found not to be caused by Kurolite or where there is a violation of these Terms and Conditions or any fraudulent activity in using Kurolite's services.

Where a refund is accepted, it will be paid only to the user's bank account. Refunds cannot be made to a marketplace balance, credit balance, or other payment source.

We are unable to guarantee a successful refund in every case, as there may be situations outside of our control; however, we will use our best efforts to process a refund where the request is valid and accepted by us.

LIABILITY AND WARRANTY

Any delay or failure to perform the Service as a result of unusual and unforeseen events or situations, faults in communications systems, or any failures and errors with the Service caused by you (including but not limited to use of a jailbroken, rooted, or otherwise modified device) or any third party is beyond our reasonable control and cannot be prevented on our side; therefore, we are under no obligation and shall not be liable for such loss or damages.

You understand that the service was not created to fit your individual needs; therefore, this service is provided AS IS and AS AVAILABLE. You shall ensure that our provided services are properly configured and compatible with your needs and device.

In the event of disruptions or force majeure that significantly impact the Service, rendering it unable to function properly, Kurolite will use its best efforts to ensure the continuity of the Service and to mitigate such risk. In this event, you agree that Kurolite does not have any control over such disruptions, and therefore you understand and agree that Kurolite shall reasonably not be liable for any damages or loss that may arise as a result of such disruption.

SUPPORT

Support.
If you have an enquiry, request, or complaint regarding Kurolite's service, please send an email to [email protected] or contact us via WhatsApp. We will acknowledge receipt of your enquiry, request, or complaint within 1 (one) business day, and within 7 (seven) business days of receiving your complaint notification, we will investigate your complaint and update you with the results of our investigation. Availability to talk to Kurolite's representatives is 08:00 - 17:00 Western Indonesia Time (01:00 UTC to 10:00 UTC).

Reporting.
If you become aware of any unlawful usage or violation of these Terms and Conditions, please report it to Kurolite as soon as possible and no later than 7 days after the date you became aware of the unlawful action.

TERMINATION

We may terminate these Terms and Conditions and your access to our Service, with or without notification, with immediate effect and without any liability, in the event that you:

• Are in breach of any provision of these Terms and Conditions;
• Use the Service in a way that is disruptive to our other customers, or do anything which in our opinion is likely to bring us into disrepute;
• Breach or attempt to breach the security of the service (including but not limited to: modifying or attempting to modify any information; unauthorized access or deletion of data; interfering with the service, system, host, or network; reverse engineering of any kind; spamming; hacking; falsifying data; introducing viruses, Trojan horses, worms, or other destructive programs; or testing security in any way); or
• Are, in Kurolite's reasonable belief, using the Service in connection with fraudulent, illegal, or unethical activity, or permitting a third party to do so.

OTHER PROVISIONS

Governing language.
These Terms and Conditions are originally drafted in English and translated into the Indonesian language (or other language as may be applicable). Due to the nature of translation, there may be multiple interpretations of the content of both the Indonesian and English versions. In this case, the English language will prevail, and any English version interpretation will prevail over its Indonesian (or other language, as applicable) interpretation.

Governing law.
These Terms and Conditions will be governed by Indonesian law, and the parties submit to the exclusive jurisdiction of the Indonesian Courts. Kurolite shall provide the service in accordance with the relevant laws and regulations in Indonesia and in a professional manner.

Payment.
Kurolite accepts payment through third-party marketplace platforms and through payment links sent via WhatsApp. These payment methods are possible because we have a contractual relationship with the relevant providers. For any mistakes or issues in the payment process related to the purchase of the service, you are advised to approach the relevant marketplace or payment provider for such enquiry. Kurolite will do its best to assist you in this case.

No waiver.
The failure of Kurolite to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of Kurolite's other rights or provisions under these Terms and Conditions.

No partnership.
The parties hereto shall not, by virtue of these Terms and Conditions, be deemed to be a partner or agent of each other, nor shall anything herein be construed as creating a partnership, joint venture, or trust. Each party will be responsible only for its obligations under these Terms and Conditions, and neither party shall be authorized to represent or bind the other to any third parties.

Entire agreement.
This agreement constitutes the entire agreement between the parties and supersedes all prior understandings or agreements relating to the subject matter of this agreement. By using our service, you agree that this clause is binding as an agreement between us and you, based on Article 1338 of Indonesia's Civil Code.

Indemnification.
TO THE FULLEST EXTENT PERMITTED UNDER THE LAW, IN NO EVENT SHALL KUROLITE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, REGULATORY, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION ANY LOST REVENUE OR LOST DATA, ARISING OUT OF OR RELATED TO THE SERVICES.

External links.
Any external links to third-party websites may be provided by Kurolite. These sites are not controlled by Kurolite in any way, and we reasonably waive responsibility for the accuracy, completeness, legality, or any other aspect of these other sites, including any content provided on them. You access such websites at your own risk.

Third-party tools.
In using any third-party tools, software, and applications, you shall ensure that such third-party tools comply or conform with these Terms and Conditions, especially in terms of Personal Data Protection and Confidentiality.

Severability.
If any provision of these Terms and Conditions is found by an arbitrator or court of competent jurisdiction to be invalid, the parties nevertheless agree that such invalid provision shall not be part of the Terms and Conditions and that the other provisions shall remain in full force and effect.
